Terms and Conditions of XGame

INTRODUCTION
These Terms and Conditions (“T&Cs”) govern the use of XGame.io (the “Platform”). The Platform is operated by Solid X LTD, a private company limited by shares, incorporated under the laws of the Autonomous Island of Anjouan, Union of Comoros, with registration number 15875, and registered office at Hamchako, Mutsamudu, The Autonomous Island of Anjouan, Union of Comoros (“Company”).
The Platform is GLI-19 certified and operated in accordance with international standards for fairness, transparency, and responsible gaming.
Reference to “you”, “user” or “player” shall mean any person using the Platform or any services available thereon and/or any registered player of the Platform.
By using, visiting and/or accessing any part of the Platform and/or registering an account on the Platform you agree to be bound by these T&Cs, Privacy Policy, Responsible Gaming Policy and any other rules applicable to our gaming products available on the Platform (together the "Terms"), and are deemed to have accepted and understood all the Terms.
YOUR ACCOUNT
General Account Information
Reference to the “Account” shall mean an account registered by you on the Platform after accepting and agreeing to these Terms. Your Account is your connected blockchain wallet(s). You may connect and use multiple wallets, but you are fully and solely responsible for all activity conducted through them.
You are not allowed to register on the Platform and use our services if you are a resident of Australia, Austria, the Netherlands, Spain, the United Kingdom, the United States, France, Statia, Sint Maarten, Comoros Islands, Germany, Belize, Italy, Malta, Portugal, Turkey, Bulgaria, Hong Kong, Singapore, Iran, North Korea, all countries included in the FATF blacklist, jurisdictions that may be prohibited from time to time by the regulator (AOFA) and any other region where online gambling is illegal or regulated on a local level. We reserve the right to refuse customers from any other countries over and above the aforementioned jurisdictions at our own discretion.
We reserve the right to block access from restricted jurisdictions, including the use of IP or VPN detection. Players are responsible for knowing if online gaming is legal in their country.
Registration of the Account
By registering the Account on the Platform, you undertake, declare and warrant that:
you are over 18 years of age or of a higher minimum legal age as stipulated in the jurisdiction of your residence under the laws applicable to you. Individuals under the age of 18 are not permitted to use the Platform and/or any services available on it.
you will use this Platform and your Account solely and exclusively for the purpose of your genuine participation in the Platform's activities; your participation in the Platform’s activities will be strictly in your personal, non-professional capacity for entertainment reasons only;
you participate in the Platform’s activities on your own behalf and not on behalf of any other person;
you are not a resident of Australia, Austria, the Netherlands, Spain, the United Kingdom, the United States, France, Statia, Sint Maarten, Comoros Islands, Germany, Belize, Italy, Malta, Portugal, Turkey, Bulgaria, Hong Kong, Singapore, Iran, North Korea, all countries included in the FATF blacklist, jurisdictions that may be prohibited from time to time by the regulator (AOFA) and any other region where online gambling is illegal or regulated on a local level;
you are solely responsible for reporting and accounting for any taxes applicable to you under relevant laws for any winnings that you receive from the Platform;
all money that you use within your activity on the Platform is not tainted with any illegality and, in particular, do not originate from any illegal activity or source;
you understand that by participating in the Platform’s activities, you take the risk of losing money.
When registering the Account, you shall confirm your acceptance of the Terms. We use a Web3-native method for users to accept the Terms. When a user first connects to the platform, they are prompted to sign a message with their wallet. Please note that:
the signature does not transfer any funds and has no gas cost;
the message contains three key confirmations that the user:
accepts the Terms & Conditions and Policies;
declares they are 18 years or older;
declares they are not accessing the platform from a restricted jurisdiction.
The purpose of such confirmations’ collection is to create a cryptographic record of user acceptance, directly tied to their wallets; it places responsibility for age and jurisdiction compliance on the player; it ensures no unnecessary personal data is collected, consistent with the decentralised nature of the Platform.
Termination of the Account
You shall not be involved in any fraudulent, collusive, fixing or other unlawful activity in relation to your or third parties’ participation in any of the Platform’s activities and shall not use any software-assisted methods or techniques or hardware devices for your participation in any of the Platform’s activities. Otherwise, your Account may be closed.
When we close or suspend an Account for whatever reason, we reserve the right to close any future Accounts that may be registered by the same person, device, address, or that may use the same payment wallets.
PAYMENTS AND TRANSACTIONS
All payments, wagers, and payouts on the Platform are decentralised and executed directly on the blockchain. Once a transaction is confirmed on the blockchain, it is final and irreversible. We do not have custody of player funds outside of these contracts. We cannot recover funds sent to the wrong address, wrong chain, or wrong token.
Smart contracts integrated into the Platform automatically calculate and distribute payouts in accordance with game outcomes. Any applicable network fees or transaction costs are the responsibility of the player and are deducted automatically where required.
The Platform does not provide any guarantees regarding transaction speed, blockchain network performance, or network fees. Players accept all associated risks when conducting blockchain transactions.
In the unlikely event of a smart contract malfunction, any corrective actions can only be initiated from the wallet that executed the original transaction. Players acknowledge and accept that the Platform cannot manually alter blockchain transactions.
Players are responsible for maintaining secure access to their wallets. The Platform is not liable for any losses due to wallet compromise, theft, or unauthorised access. We cannot issue refunds under any circumstances.
By using the Platform’s services, players acknowledge and accept that blockchain-based transactions carry inherent risks, including but not limited to network errors, technical failures, and irreversible mistakes. The Platform explicitly disclaims any liability for losses arising from such events.
FAIR PLAY & AML/CFT POLICY
As part of licensing obligations, we follow fair play and anti-money laundering (AML) standards. Verification may be requested if required by law, licensing authority, or in cases of unusual activity.
On-chain transactions are transparent and may be monitored for suspicious activity. We reserve the right to restrict or block users in line with applicable AML/CFT obligations.
Suspicious activity may be reported to the competent authorities of Anjouan.
PRIVACY POLICY
We process limited personal data to operate the Platform and meet licensing requirements. What information do we collect:
wallet address;
IP address and device information;
gameplay and transaction data (on-chain);
additional verification details if required by law.
How we use the collected data:
to operate the Platform and enable gameplay;
to comply with legal and licensing obligations;
to prevent fraud or misuse;
with consent, to provide updates or promotions.
Data is retained while you are an active user. After account closure, records may be kept for up to 5 years as required by law.
We may share information with:
licensing authorities in Anjouan;
law enforcement agencies when required;
compliance and infrastructure partners.
You have the following rights in terms of collected information:
right to access, correct, or request deletion of data (subject to legal retention);
right to restrict or object to processing;
right to withdraw consent for marketing communications.
RESPONSIBLE GAMING
Gambling is entertainment, not income. Players may self-exclude or request support for responsible gaming by contacting us.
COPYRIGHT
All intellectual property rights, including but not limited to the Platform, its design, graphical elements, logos, software, smart contracts, content, user interface, documentation, and any other materials provided on or through the Platform (collectively, the “Intellectual Property”), are owned exclusively by the Platform and/or its licensors.
By accessing or using the Platform, players are granted a limited, non-exclusive, non-transferable, revocable license to use the Intellectual Property solely for personal purposes in connection with participation in the Platform’s activities. Any other use, including but not limited to copying, distributing, sublicensing, selling, modifying, reproducing, publicly displaying, creating derivative works, or otherwise exploiting the Intellectual Property for commercial purposes or for any purpose not expressly authorised by the Terms, is strictly prohibited.
Players are expressly prohibited from:
attempting to decompile, disassemble, reverse-engineer, or otherwise derive the source code, underlying logic, architecture, or algorithms of the platform or smart contracts;
attempting to bypass, disable, or circumvent any security measures, access controls, or authentication mechanisms of the Platform; gaining unauthorised access to any part of the Platform, servers, databases, wallets, or user accounts;
using the Platform or the Intellectual Property to engage in fraudulent, abusive, or illegal activity, including but not limited to exploiting software vulnerabilities, conducting attacks, or manipulating outcomes;
copying, recording, or reproducing the Platform’s content or assets in a manner that could facilitate unauthorised use or redistribution.
All rights, title, and interest in the Intellectual Property remain solely with the Platform. Nothing in these Terms grants players any ownership, rights, or licenses other than the limited rights expressly set forth herein. Players acknowledge and agree that unauthorised use of the Intellectual Property may result in termination of access to the Platform and/or other measures to prevent misuse, in addition to any legal remedies available to the Platform.
LIABILITY
The Platform is not liable for any downtime, server disruptions, lagging, or any technical or political disturbance to the gameplay.
The Platform shall accept no liability for any damages or losses which are deemed or alleged to have arisen out of or in connection with the Platform or its content, including without limitation, delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any person's misuse of the Platform or its content or any errors or omissions in content.
The Platform, including all services, smart contracts, and software, is provided “as-is” and “as available”. The Platform makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or error-free performance. Players acknowledge that the Platform is experimental in nature and may be subject to technical failures, delays, interruptions, or errors due to blockchain network issues, third-party services, external attacks, or other factors beyond the Platform’s control.
The Platform does not guarantee the suitability, stability, reliability, or maintainability of its services for any specific purpose. All smart contracts are executed automatically and, while audited where possible, may contain vulnerabilities or malfunction unexpectedly.
Players are responsible for maintaining the security of their wallets, private keys, and credentials. The Platform is not liable for any losses resulting from unauthorised access, phishing attacks, malware, or other security breaches.
The use of the Platform does not constitute investment advice. Players acknowledge that cryptocurrency transactions carry inherent financial risks, including volatility, network congestion, and irreversibility, and that they use the Platform entirely at their own risk. The Platform depends on third-party blockchain networks, wallets, and decentralised protocols, and does not assume responsibility for any failures, delays, or errors caused by such third parties.
INDEMNIFICATION
You agree to defend, indemnify and hold us harmless from and against all claims, responsibility, damages, losses, and expenses, including reasonable legal and accounting expenses, arising from:
any breach by you of any of these Terms;
your use/misuse of the Platform;
a violation by you of applicable law, our or third party's intellectual property or other rights, or any agreement or terms with a third party to which you are subject.
We reserve the right to handle our legal defence however we see fit, including instances when you indemnify us. Therefore, you agree to cooperate with us so we can execute our strategy.
APPLICABLE LAW AND DISPUTE RESOLUTION
These Terms shall be exclusively governed by and construed under the laws of Anjouan. You agree that any dispute, conflict, claim, or controversy directly or indirectly arising out of, in connection with or relating to these Terms, including, without limitation, those relating to its validity, its construction or its enforceability, shall be settled through amicable negotiations directly with us following the principles of good faith and cooperation. If attempts to reach a consensus through the negotiations fail, the dispute shall be settled by the Anjouan courts or arbitration in accordance with the applicable laws.
Any cause of action or claim you may have must be commenced within one year after the claim or cause of action arises.
PERSONAL INFORMATION
We will comply with applicable data protection laws in respect of the personal information you supply to us. Your personal information is processed in accordance with our Privacy Policy.
TERMINATION
Termination by the Platform
We reserve the right at our sole discretion with prior notice to modify, suspend or discontinue the Platform, content, features, etc. at any time. You agree that we shall not be liable to you or any third party should any of the preceding occur. We reserve the right to take whatever lawful actions we may deem appropriate in response to actual or suspected violations of these Terms or applicable laws, including, without limitation, the suspension or termination of your license and access to the Platform. We may cooperate with legal authorities and third parties to investigate any suspected or alleged crime or civil wrong to you or any third party, should any of the preceding occur.
We reserve the right to take whatever lawful actions we may deem appropriate in response to actual or suspected violations of these Terms or applicable laws, including, without limitation, the suspension or termination of your license and access to the Platform.
We may cooperate with legal authorities and third parties to investigate any suspected or alleged crime or civil wrong.
Termination by the User
You may terminate these Terms by no longer accessing and using the Platform or by contacting us.
In case of termination:
you will lose access to the Platform and its tools;
all permissions and licenses under these Terms will be immediately terminated.

We kindly ask you to communicate respectfully with our team. We reserve the right not to respond to communications containing offensive, abusive, or inappropriate language.
OTHER TERMS
XGame operates on smart contracts that are provably fair and transparent. Independent audits and GLI-19 certification ensure compliance with strict gaming standards.
We may transfer our rights and obligations under these Terms to a third party, but this will not affect your rights or our obligations hereunder. You may not transfer your rights or obligations under these Terms to another individual or entity.
We reserve the right to modify these Terms or the Platform at any time at our sole discretion. If such changes affect your use of the Platform, we'll notify you via email or other communication means mentioned above before the changes' effective date. If you continue to use the Platform, you agree to the updated version of these Terms.
If any provision of these Terms is determined to be unlawful, void, or unenforceable, the remaining provisions of these Terms will continue to be fully valid, binding, and enforceable.
A printed version of these Terms shall be admissible in judicial or administrative proceedings based on or relating to the use of the Platform to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
